1. Scope
This privacy policy applies to personal data processing carried out in connection with Vivastream App across supported service environments.
It covers, among other things, processing linked to content access, account creation and use, live events, creator livestreams, VOD, access purchases, gifts, support, community features, search, editorial personalization, and platform security.
2. Controller
The controller is Vivastream App, LLC, 2261 Market Street STE 85068, San Francisco, CA 94114, USA.
For some operations, especially where payment providers, infrastructure providers, authentication services, streaming partners, or technical providers act under their own obligations, processing may also be carried out by processors or, where relevant, by separate controllers for the part that belongs to them.
3. Categories of personal data
Depending on how you use Vivastream App, the following categories of personal data may be processed.
- account and identity data, such as display name, identifier, email, technical account identifiers, language, and preferences;
- login and authentication data, such as login history, session tokens, security information, and verification traces;
- navigation and usage data, such as pages viewed, opened content, categories consulted, platform journeys, editorial interactions, timestamps, and device or browser technical data;
- content viewing data, such as live events opened, creator livestreams viewed, VOD and replay sessions, playback progression, and some access history;
- transaction data, such as access purchases, payment status, gifts, confirmations, incidents, or disputes;
- communication data, such as support messages, comments, chats, reports, and gifts displayed in a live experience where the product supports it;
- security and fraud prevention data, such as logs, anomaly traces, risk signals, and information useful to defend Vivastream rights;
- third-party data, such as information transmitted by authentication, payment, infrastructure, or protection providers where necessary for the purposes described below.
4. Sources of collection
Personal data may be collected directly from you when you create an account, log in, purchase access, send a gift, use support, post a comment, perform a search, set preferences, or browse the platform.
Data may also be generated automatically when you use the service or received from technical partners such as authentication, payment, hosting, analytics, protection, or streaming providers.
5. Processing purposes
Vivastream App processes personal data for the following purposes.
- providing the service and making the platform available;
- creating, managing, and securing your account;
- granting access to live events, creator livestreams, VOD, and editorial content;
- processing access purchases, gifts, and related confirmations;
- handling support, user requests, and reports;
- enabling community features such as comments and some chat spaces;
- personalizing some recommendations, editorial surfaces, follow flows, and content suggestions;
- measuring service usage, improving performance, and fixing incidents;
- detecting, preventing, and handling fraud, abuse, Terms violations, or rights infringements;
- complying with legal, regulatory, contractual, or rights defense obligations.
6. Legal bases
Where required by applicable law, Vivastream App relies on one or more appropriate legal bases depending on the relevant purpose.
These may include performance of a contract or pre-contractual measures, compliance with legal obligations, Vivastream legitimate interest in operating and securing its service, and, where required, your consent, especially for some trackers or processing that cannot rely on another adequate basis.
7. Payments and paid interactions
Access purchases, paid VOD content, and gifts may involve data processing by Vivastream and by payment providers, including Stripe, Apple, and Wave Money, depending on context and available integrations.
Vivastream does not necessarily have access to all banking or payment data entered into the interfaces of those providers. Some payment data is processed directly by those providers under their own obligations and policies.
Vivastream may nevertheless receive confirmation, failure, status, transaction identification, risk, or dispute data to the extent necessary to provide access, prevent fraud, handle support, or defend its rights.
8. Comments, chat, support, and visible gifts
When you use comments, chat, support, or visible gift features within a live experience, the data you publish or send may be visible to other users, the relevant creator, moderation teams, or support teams depending on the feature involved.
You should avoid posting sensitive data or information that you do not wish to make available in the normal context of the experience.
9. Personalization and recommendations
Vivastream App may use some usage data, viewing history, consulted categories, creator follow signals, or editorial interaction data in order to personalize recommendations, highlight some content, or organize discovery surfaces.
These processing activities are intended to improve the relevance of the user experience and the editorial organization of the service. They are not intended to produce legal or similarly significant decisions based solely on automated processing.
10. Data recipients
Your data may be accessible, on a need-to-know basis and within the scope of each recipient responsibilities, to authorized Vivastream teams and to some providers, partners, and technical suppliers.
- hosting and cloud infrastructure providers, including Google Cloud Platform;
- payment providers, including Stripe, Apple, and Wave Money;
- authentication, security, technical monitoring, analytics, or support providers;
- creators or partners, only where necessary to operate an experience or manage a dispute, report, or verification;
- authorities, courts, rights holders, or advisers where required by law or necessary to defend Vivastream rights.
11. International transfers
Vivastream App and some of its providers are located in, or operate from, countries outside your country of residence. International data transfers may therefore occur, including to the United States or other countries where Vivastream or its providers operate.
Where required by applicable law, Vivastream seeks to implement appropriate safeguards for such transfers, such as contractual commitments, technical and organizational measures, or any other recognized transfer mechanism.
12. Retention periods
Personal data is retained for no longer than necessary for the purposes for which it is processed, subject to longer retention where required by law, accounting, tax, contract, or rights defense obligations.
As a general rule, account data is retained for the life of the account, transaction data for the period necessary to manage purchases and related obligations, security logs for the period necessary to prevent and handle incidents, and support requests for the period necessary to process them and later defend Vivastream rights if needed.
13. Security
Vivastream implements reasonable technical and organizational measures designed to protect personal data against unauthorized access, loss, destruction, alteration, or unlawful disclosure.
However, no system provides absolute security. Users remain responsible for protecting their credentials, their technical environment, and the confidentiality of the information they choose to publish in community areas.
14. Your rights
Depending on applicable law and subject to the relevant conditions, you may have rights of access, rectification, erasure, restriction, objection, portability, withdrawal of consent where consent is the legal basis, and the right to lodge a complaint with a competent authority.
Where California law applies, you may also benefit from rights to know, access, delete, correct, and, where relevant, limit some uses of your personal information, subject to legal exceptions.
Vivastream does not sell your personal data in the ordinary sense of that term under this policy. If a local legal qualification were to require a specific treatment of data sharing or advertising-related use, this page should be updated accordingly.
15. Exercising your rights
You may exercise your rights or ask a question regarding your personal data by writing to assistance@vivastream.app. Vivastream may request reasonable additional information to verify your identity and prevent fraudulent requests.
Some requests may be refused, limited, or handled differently where the law allows or requires it, including where data must be retained, rights must be defended, or identification is not reasonably possible.
16. Minors
Vivastream App is intended for persons aged at least sixteen (16). Users aged sixteen to seventeen may use the service only under the responsibility of their legal representative.
Access purchases, paid VOD content, and gifts made by users aged sixteen to seventeen must be authorized by their legal representative.
17. Changes to this policy
This privacy policy may be amended to reflect service evolution, processing changes, legal requirements, or Vivastream organizational changes.
The applicable version is the version published on the platform on the date of consultation, subject to mandatory law. In the event of a material change, Vivastream may inform users by any useful means.
